Ebay item sold elsewhere - I wasn't out of order was I?!

I'm an infrequent ebay user but it finally happened, a bad transaction:

- Bought item using buy it now on Saturday night. Paid via paypal.
- Sunday got refunded by seller with "sold just as you clicked buy it now"
-Even though I was refunded I sent a polite "what??!" email then a few minutes later left a negative feedback.

The item wasn't described as advertised elsewhere - though I don't think that is an excuse if it was really.

I appreciate the money was refunded reasonably quickly so he wasn't scamming, and I guess I could have waited for a reply, but even so I think I'd have left my (first ever) negative feedback.

I don't think they can neg me back as a buyer but if they can so be it.

IMHO no, they shouldn't have been selling elsewhere while they had an active auction going on. You paid your money and the item wasn't actually available for sale, so personally I believe a negative is justified.

Possibly marginal, but you were within your rights to neg IMO. No, they can't neg you.

think you are well within your rights to be honest, people seem to be really scared of giving someone negative feedback. In all honesty unless you get your goods within reasonable time, you should consider leaving negative feedback (and i mean consider, not definitely).

Would you deal with this guy again? Should others be warned that the guy sells items he doesn't have?

I have 100% positive feedback on my ebay account, the reason being I always communicated well and sent my items promptly and they were received and people were happy with them.

The best way to avoid negative feedback is doing like I do, I think people have a right to see someone isn't a good ebayer and the best way to do it is with leaving negative feedback where due

Who cares, it's just a neg feedback on a crappy website, accurately recording some negative behaviour of theirs, it's not like you went round and burnt their house down.

A lot more people should neg in my opinion.

And this sort of situation is exactly why eBay made that change to the feedback policy. Too many idiot sellers were leaving revenge negative feedback for blameless buyers.

Unfortunately it also leaves too many blameless sellers at the mercy of idiot buyers..

Like the guy who is currently threatening to raise a PayPal dispute/leave negative feedback, because I dared to charge £3 for posting an item but then only paid £1.97 on the shipping, now He wants a refund of £1.03...

I might of been more open to giving him some refund if he not steamed in with blackmail...

i wouldn't refund him. what about cost of packaging / time taken to go to post office etc. the cost of sending an item is not merely the cost of the delivery service - that's why it's called P&P / postage & packaging. i would only refund in situations like that if i grossly overestimated the postage. your buyer knew the total amount (incl. p&p) and bid to that, so i don't see why he has reason to complain.

I've just fallen victim to a total cock of a buyer - some people just shouldn't be allowed an internet connection.

I sold a Tarzan Sp Ed DVD. A guy emailed me an hour before auction ended to asking of it was a legit version (I've got almost 2000+ve 100% feeback and have been trading for a decade).

He wins it, then emails me to say he'd bid in error (He won it at £4.50??!!).

So I'm all nice and almost instantly cancel the transaction and relist the item, meanwhile this moron has left me neutral feedback (my first ever I think), saying he didn't want the item but couldn't figure out how not to bid once he got to the bid page.

Total cock, and there's nothing I can do about it.

Thankfully the number of cocks on ebay who are willing to pay over the odds for second-hand crap just about outweighs the people like this.

Contact ebay and ask them to remove it. At worst they'll ignore you, at best you'll get your 100% record back.
