paying £2.94 per MB up to a maximum of £1.47 per day, you will be

I just managed to get out of my 18 month contract.

The number of peope wiggling out of their contracts will be extremely low compaired to the people who will let the new T&C pass. They will make any lost money up on the better terms they have written themselves.
Also it would be a legal and logistical nighmare having millions of customers all on differing T&Cs.

If you are midcontract you can get out of it allowing you to take a new deal and hence a new phone. Sell the new phone as soon as you get it and bang you're a few hundred quid up (or you have a shiney new phone)
The short a time you've been into your contract the better the deal.
i got out of mine eventually. just ask to speak to a supervisor.
I'm going to move this to the Mobile forum.
Does this affect all Orange contracts? My wife is with Orange and she can't get a decent reception where she needs it most so we're hoping to move ASAP.

According to the a lot of posts on the other forum it seems to be only for people who have had the text from Orange about the changes. But some people have been getting away with it even if they haven't.

Basically tell them that you're not happy with the price increase and that according to the terms below you are within your rights to cancel and you wish to do so. I'm going to give it a try when i'm on my lunch break.

"Terminating your Contract because Orange has changed its terms
4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes). However this option does not apply if:
4.3.1 we have increased the Charges by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices published by the Central Statistical Office in the Monthly Digest of Statistics in any 12 month period;"

You don't need to pay the charges, once O vary the charges in excess of RPI then you have the right to cancel. If you have a problem just refer them to the terms of the contract via the link above. I would suggest that you call 150 and select the option for leaving O. If at first you don't succeed just hang up and try again with another CSR.

As long as i dont phone any 08 numbers. :D
However my mother-in-law just phoned up as she was also unhappy about what was being offered to her as an upgrade, and they asked on the phone if she was cancelling just because of the price increase. She is in month 15 of an 18 month contract. She said the reasons were the price increase and the poor upgrade offer.
The guy was very helpful and she now has the phone she wanted in her upgrade coming tomorrow, on an enhanced tarrif at a lower price.
She did get the offer to terminate her contract, but went for the upgrade. :thumbs:

Anyone know why it only affects contracts made after the end of May? The article suggests that, but then there are people saying they're cancelling with only a few months left on their contracts, so obviously they had contracts starting before May.

Colin I don't think this is true. I started my contract in January this year and i've had the text message telling me of the changes being made to my contract.
I'll give it a go then :)
Hrm - I'm down to receive a text, but haven't yet and they're claiming they can't do anything until I do get the text - ********?

Yeah it seems like you do have to wait until you get the text.

I've had the text, but I'm still not sure I understand what they're saying about the data charge. Are they only going to make you pay this 58p a day on days when you access the web?
I haven't received a text either yet. That article above says you should ask the date that you are due to be sent the text and let the operator now that you will call back on that date if you receive the text or not. It says you should take their name etc and get them to put a note on the account to the effect that you've been told the text will be sent at a later date.
I'm 4 months into a 18 month contract at the moment I get no where near to going over my allowance (400 x-net, unlimited landline). I could still try to cancel but I'm not sure if its worth it as I'm on a retentions deal for under £10 a month with mobile internet. Not sure I could get a deal quiet as good anywhere else.
Might check out what else is available but haven't really had any hassles with Orange on a cheap deal without need for cashback so I prob will stick with them.
Yeah I think the 58p would be the max charge only on days that you used the internet I think it was £1.50 before so thats an improvement.
As I understand it, you're now charged 58p/day regardless of how much you use - so log on and download 1K and it'll cost 58p. Whereas before you were charged based on how much you download - so if you use it a lot then you will be better off, but if not and only download a tiny bit of data you'll be charged more.

Phoned Orange when I got back home and got put through to the CS team where he told me he would have to be put through to the dissconnections team. I actually got put through to the retentions team where the guy said "so you've had a message from Orange saying that you can cancel your contract"
I was going to correct him and say it was about the price changes but I just said yes.
He then said right that will be cancelled for you tomorrow.
I then told him that I wanted to get my PAC code as I want to take my number over to another network. He said that it would take 4 - 5 days to come through the post. I was fine with this.
Just before finishing the call he said I have to advise you that if you try and go for another Orange Contract phone in the future I may be denied it as i'm cancelling my phone in this way. He said they might change their mind in the future.
I haven't read anyone else being told this before but I just told him it was ok. I'm sure they won't deny it. After all they want customers and I'm sure they'll be trying to take on as many people as possible after so many people have cancelled.
I think i'll be moving to the T-mobile solo card for the time being. I just got my HTC Touch HD in Jan and i'm more then happy with it for the moment. Will wait to see which new phones come out before getting on to another contract.

I was 6 months into a 2 year contract (Touch HD). Got out no problems with no arguments or agro. Guy was really nice about it. May get an Iphone 3gs now as I fancy the functionality having played with a few at work (seems to be the current managers phone of choice and I was the odd one out LOL). Number was cancelled in less than 12 hours.

No matey, they won't laugh at you. i am 8 months into an 18 month contract and called them up. Said i was calling about a text i had received from them re price increases. He asked me what action i would like to take on that, to which i replied "i'd like to cancel my contract please". He was very nice about it and it is going to be cancelled on monday. My pac code is being posted out to me and as soon as my number is transferred, that will be the end of my billing.
Now, what phone to go for next......
This was even easier than the time i cancelled my wifes O2 contract for a similar reason. I really don't understand why they don't just increase the charges for anyone taking out a new contract, and then they wouldn't have this problem.

You know what I am/was in the same boat. Really and truly I had no problem whatsoever with Orange. My monthly charge was perfect for me and at a good price. I've never had any major problems with orange and I am a premier customer.
But once, they screwed me over when I wanted an upgrade. Initally they said it would be £90, they said if I waited for a month it would go down to £70 so I waited. Then when I phoned again they told me the following month it would cost £50 so I waited. When I called them up again they said I couldn't have an upgrade. :mad: I've always felt some resentment towards them because of this. :razz:
The T-mobile solo tariff is giving me more mintues, unlimited text and unlimited text for the same price as I was paying with orange. The only difference is that its a rolling 30 day contract.
I'll just wait till there is a phone that I really want before going back on a permanent contract. I'm happy with my HD at the moment.:clap:

I had about 14 months left of my Contract and rang them today. The guy on the line said the new charges wouldn't effect me unless i went over my monthly minutes, i said i might and he offered me an extra 400 minutes a month for free, when i said no thanks and asked for my Pac code he said sure no probs. I was wanting to move to O2 anyway so nice one:D

After seeing this thread I phone 150 and spoke to someone in the North East to say that they've broken the Terms of my contract. He asked if I wanted to cancel, and I said may be, depending on the upgrade they could offer me on Blackberry Curve. He put me on hold and came back after a few mins with this:
Free phone
400 mins
400 texts
Blackberry email (the £5 BB tax)
unlimited internet browsing (think fair usage is 250MB)
£24 per month
I'm very happy beacause I know a couple of people who have got the same tarrif for £40 :thumbs:

I've got to wait until August 2009 before I can upgrade. Has anybody still under contract phoned and asked them to cancel and then been offered a new upgrade and money off their bill if they stayed?

Have orange notified me about these changes in T&C because i cant remember receiving any correspondance regarding this. I am on the dolphin 25 contract and would like to get an iphone so do i just ring up orange and tell them to cancel my contract? :shrug:
I got a text around the end of july saying some data and call charges have changed, i phoned the guy and i said wanted to cancel due to the change in charges he said yeah no bother, was no hassle at all.
I was on dolphin 15.

I went to account enquiries.
Did this the other day after being tipped off by an orange employee, not sure I had the text just said I'd deleted it so wasn't sure when I got it, tried to reduce the price of my tariff to keep me (and the OH, both on Dolphin 35, though she pays 10 less than me for more minutes, both offered a further £10 reduction), said no as at home/work the coverage is terrible, so PAC code on the way.

Cheers my dears, I gave them a call and spoke to two very pleasant and helpful ladies who in the end offered me double minutes and a tenner off each month for the remainder of the contract (6 months).
I said yes, got it turned into double texts instead as I don't use the minutes, and hung up quite pleased. They've obviously got some training into the staff now, I didn't even need to refer to the T+C's which I had in front of me :)

Just phoned Orange having received the text earlier today. Got through in under a minute! Said "I've received a text today about some price changes and since this changed to T&C of my account I'd like a PAC please". She didn't offer any incentives (which I didn't want anyway) and after a few seconds of keyboard tapping, she said the PAC would be in the post in 3-4 days. Easy!

I've just done this too. Very painless call lasted no longer than 3 minutes.
Offered me a few deals but PAC is on its way.

Because the networks often claim that their coverage is better than it is.
T-Mobile told me they had a good network in my area, but I get bugger all coverage here.
My wife is on Orange and the signal used to be good, but over the last year it's been awful - yet they claim there isn't a problem hence we really want to get out of this contract and move to O2 who have a solid signal both here and where she needs it most.

I cancelled mine the other day and was gonna use my pac code but i rang Orange upgrades and they gave me the HTC Hero for £28, 1600 minutes, unlimted text and free Orange sat nav on my current Dolphin 35 plan. I've got to pay £5 a month for the data plan but still a great deal imo:D

No Orange signal upstairs, some signal downstairs and not bad in the back garden. My other daughter, also on Orange, has perfect signal in her house, which is 10 doors up on the opposite side of the road. Both houses have excellent O2/Vodafone signal throughout
Can you explain to me how I could check this before I bought it, bearing in mind that not having a signal where you want it is not a reason to back out of a contract?
. I've got to pay 55553 a month for the data plan but still a great deal imo:D

In the past I have tested them with a PAYG sim from the relevant network.
Interestingly where i live the maps the different providers put on their websites are very accurate, we only get Orange.

Then don't mate, cancel and ask for your pac code, which won't actually cancel your contract until you use it. You would have the same deal as you have now but will be free to leave anytime you want. You could also go for an early upgrade or even just a sim only deal.

Also got another mobile and mobile broadband on the account.
My cousin got his PAC code last week. They've called him since offering better deals for him to stay. The latest one was a HTC Hero, 1200 mins, 1000 texts and data for £25. Phone was free.
I got my HTC Hero two weeks ago on upgrade but got the text today myself. Will try cancelling tomorrow.
Finally got round to cancelling mine tonight after getting the text on Friday. Offered me bugger all interesting to get me to stay so I got them to send me out a Pay As You Go SIM so the missus could keep the number.
Called twice and they weren't having it. They said that as I haven't been over my allowance in the last few months I can't cancel. Load of crap. Even though she agreed that if I went over in future it would affect me. Will try again tomorrow.
I called today to see if I could get a better deal, rather than cancel as I have been over my monthly allowance for the last 3 months. I went through to disconnections to be told that the staff had received a message this morning saying they were not going to alter the prices now and not to cancel any more contracts.
Not sure wether I believe the guy I spoke to or not?

They may have a discretion about altering prices, but they have no choice but to terminate your contract as they've changed the conditions!

Ive had the text Sunday, thought Id have 30 days but as of this morning no one has anything.
Its all over MSE and also seen at OcUK. I also spoke to Orange directly.
They agreed to send out our PAC code yesterday, so I guess we were lucky. Better turn up now.

Have to say im glad I had the chance to cancel as I now understand the Iphone fanboys - it trully is fantastic (Im saying that as an ex Touch HD user).
Hopefully Orange have learned from this - in many cases they have handled it spectacularly badly.

Mobile phone giant Orange has reversed its decision to put the price of its calls up next month after the Guardian contacted it suggesting it was breaching its terms and conditions by not allowing customers to leave.
The company recently sent text messages to its customers informing them that from mid-September the cost of calls not included in their talk plans, such as 0870 numbers and accessing their voicemail, would rise from 5p to 14.7p a minute.
At the same time it said it would increase the charge for browsing the internet to a flat 60p a day, regardless of how much time users spent online.
Many customers took the opportunity to cancel their contracts on receiving the news, as Orange's terms and conditions allow them to do so if there is an "excessive increase in the charges" made.
However, shortly after the text alert prompted hundreds of customers to leave, Orange started turning down cancellation requests, reportedly telling customers they couldn't leave if they were not already using their full calls allowance or if they had never before called 0870 numbers.
It told some customers that if they had a problem with the decision they should contact telecoms watchdog Ofcom.
Outraged Orange customers then contacted guardian.co.uk/money and posted complaints on consumer website Bitterwallet suggesting Orange had breached its own terms and conditions.
Posting on Bitterwallet, Orange customer 'Sam' said: "I tried to cancel on Saturday and got the same response, 'you aren't entitled to cancel as you have not gone over your minutes in the last 3 months'."
"I told them [customer services] that I might go over my minutes in the future though and his reply was 'yeah, and I might win the Lottery tonight!'."
After being contacted by the Guardian, Orange today made a spectacular U-turn admitting it had "made a mistake in not recognising the frustration and confusion that our customers would feel as a result of [the changes]."
A spokesman said that as a result Orange has decided not to go ahead with the price increases.
"It is normal practice for businesses to make pricing changes, and whilst we clearly cannot rule out any future changes we know that transparency and consistency in our policies is extremely important to our customers," he said.
"Orange apologises to those customers who found the messages unclear and any subsequent misunderstanding this has caused. We will be reviewing all policies and procedures for price changes to make sure that they are clearer in future."
However, for those customers who have already confirmed their cancellation and requested to transfer their number to another provider, the cancellation still stands.
Paul Smith, editor of Bitterwallet, said: "This is an issue that caused plenty of anger and misery amongst Orange customers.
"Dozens of readers cited examples of call centre operators deliberately misleading them with regards to Orange's own terms and conditions. If Orange had informed all customers of the changes and allowed those who wished to cancel to do so, this would have worked out far better for everyone.
"Instead, they've damaged their own reputation and future revenues, and been forced to admit they got it wrong."

Yeah right! More like they underestimated how many customers now know their rights and are not willing to be walked all over by big corporations such as Orange, and they were going to lose a hell of a lot of money over this.

Did anyone find themselves in credit by far, far more than expected after doing this? I received my cheque today, and am a little confused as to how they have come to the conclusion they owe me over 200 quid!
Just a heads up, Orange tried to charge the sister-in-law for ending her contract early (agreed when the terms and conditions were announced), a quick phone call to Orange cleared it up but keep your eyes out...

I had a text from Orange today, to say that they will no longer by making the change:
Hi from Orange. We told you recently about some price changes we were going to make in September to the costs of calls & mobile internet browsing. We're no longer making these changes, so your charges will remain as they are today. Sorry for any confusion.
Oops!
I wonder if they'll try to get back anyone that cancelled their contracts on the back of the change?

Nope - the Chief Exec said they were honouring the cancellations that had been (legally) requested (I was one of them - got an Iphone instead w00t !)

I'd swap my texts for a bloody consistent signal! It's not as if I live anywhere remote, it's the Thames Valley for heaven's sake, yet I can't get a signal at home, or in various parts of my office! As soon as my current contract expires, I'm going to give Orange the boot!

Same problem, although i do not live in the Thames Valley i live near crawley and never get any signal at home. O2, iphone, better signal - no contest
