my step daughter saved up her money and bought a pink samsung j700 for £70 nearly 6 months ago.

After breaking and being fixed it lasted 2 days so was sent off again, lasted another 2 days, then sent off again and lasted another 2 days...

With me? its been repaired 3 times when it broke again i refused the phone and said i wanted a new one they said im only entitled to a refurbed one, i didnt even know if this was strictly legal. Anyhow they then offered me the choice of a samsung e250 which is even less specced that the j700, they then offered a SE 303 which is quite a nice slider phone which i said i would accept upon going home with it and trying to use it the earpiece doesnt work and it had numbers in the memory.

Went to take that one back yesterday and none of the staff could do anything as the manager wasnt there, i have to go back again tonight.

What are my rights here, i feel like giving them the phone and taking stock to the value of the phone as im being pushed around from pillar to post and so far i have been very nice and calm.

Any ideas forumites?

Personally (and i'm sure others could comment better than I), i would return it and say it's not fit for purpose, and the "new" return they gace you was in fact "used" which is against the trades descriptions act. If it were me, i'd insist on a NEW replacement, or more likely a Full refund and go somewhere else that might provide a decent standard of customer service without being lied to!

Tell the manager :

The original phone was obviously not fit for purpose as you had it 6 months, and of those 6 months you only had actual use of it for xx months.

the replacement that was supplied was in contravention of the trades descriptions act, where a used item has been passed off as new.

If it was on contract, i'd also be looking for compensation for the amount of time it was away.....

you dont get a brand new phone as a replacement, as your phone isn't new... you get a phone that is refurb'd your stat rights are a refund replace or repair (which is down to the retailer which one you get) but nowhere does it say they have to replace it with a brandnew out of the box phone.... cpw are a bit of a arse ... as the manufacture replace phones if they have been repair 3+ times but it depends on which service centre they use to carry out the repair..

unfortunately its not contract as my step daughter saved up her pocket money and bought it her self, hence why im so annoyyed as ive tried to teach her the value of money and then she/me gets treated like this.

Anyway manager said they couldnt replace it, so i could either send the second hand(new)one back again for repair or have another replacement which is what i opted for.

She did how ever offer me £10 credit for my step daughter which calmed me down but my point is how is it legal the amount of time they have had the phone? If what they do is legal i think its very very unfair the things they can get away with
