My dad bought a digital camera off of the seller "digigood" - 40,000+ feedback.
The item makes out it is new - well, it didnt specify that it was a grey import or reconditioned.
The listing is here:
eBay (http://www.thedvdforums.com/jump2.php?url=http://rover.ebay.com/rover/1/711-1751-2978-71/1?AID=5463217&PID=582776&mpre=http%3A//cgi.ebay.co.uk/ws/eBayISAPI.dll%3FViewItem%26item%3D290075773035)

At the bottom, there is a small bit on it being re-manufactured but throughout the listing it claims there is a FULL manufacturers warranty etc
Essentially making out it is a new camera with UK specification.

The seller originally denied my Dad paid for the item via PayPal even thouh he sent tracking numbers, screen shots etc.
After 2 weeks, the buyer filed a non-paying bidder against my dad which he proved to eBay that he HAD paid and they agreed.

The item was delivered on Friday. It is 2nd hand, grey import that only focuses in Macro mode.

Because my dad left negative feedback, they are refusing to replace it unless he withdraws his feedback.

I told him to report them to eBay and file for a chargeback after returning it to them via Recorded Delivery.

How would you handle it?

It says 'remanufactured', which I would say means the same thing as 'reconditioned'.

Not sure how you infer that? A manufacturer will often give a full warranty for refurbished items (Apple do).

That a bit poor, but I suspect that could have been because he didn't go through the normal eBay checkout process.

If it's faulty or not as described then make a claim through PayPal.

The seller could have made it more noticable. In the description at the top, the seller left "Condition" as blank - he could have put used/refurbished.

Nope - it's slapped about all over the listing. When it arrived, he compared the UK spec to the one he received and it was different indicating it was a grey import.

I suspect that could have been because he didn't go through the normal eBay checkout process.
Nope - I logged onto his account (i originally thought that) and it was paid through eBay's PayNow link and using his PayPal account. Shows up all over ebay AND the listing as paid.

If it's faulty then make a claim through PayPal.
I think this is what we are gonna have to do...

Cheers :)

"Because my dad left negative feedback, they are refusing to replace it unless he withdraws his feedback."

That sounds like Feedback Extortion - another Ebay T&C thing

"I told him to report them to eBay and file for a chargeback after returning it to them via Recorded Delivery."

However you send it back (if you do), make sure it is insured for damage / loss to its full value. Recorded delivery only covers you to about £30, which isn't enough.

Their auction terms state that they will repair / replace the item, so I can't see how they can avoid doing it.

Like AWaite, I would suggest going through paypal for a chargeback if the seller refuses to honour the warranty and it is obviously broken.

I came across this seller yesterday, while I was browsing for MP3 players. I took a look through their negative and neutral feedback and it put me right off. I personally avoid purchasing electronic products from abroad if I wouldn't be able to get them serviced within the UK. If you can send it back for repair, your postage costs are not usually refunded and it could get expensive if multiple faults arise and the seller is located outside the UK.

They apparently are UK based. Sorry, when I said recorded delivery I meant special delivery :)

If my dad would have spoken to me first, I would have told him to avoid them and order elsewhere. Only reason he wanted it is that he bought an underwater casing for it so my sister can take photos when snorkeling.

If they're registered as a business seller then they're fully bound by the Sale Of Goods Act and are therefore obliged by law to replace/refund if faulty...

I'd gently remind them of that fact and then report them to Trading Standards anyway.
