I'm not sure how I stand, I bought a brand new 15" CRT TV from ebay and it's basically somebody selling out of the shop.
The guy didn't send it when he was meant to but did a few days later, however when the courier came he had 2 for me - yes 2 so I took them and put one aside (this was about 3 - 4 weeks ago). Got a call today saying that they realised they had sent me 2 and did I still have the other one as they would like it back. They said that they would get it picked up by the courier. So do I have to send it back? what is the law at the end of the day it was an ebay sale?

Any comments? :help:

So what was the question? Do you want to keep the second item for free?

I had this with a tyre I ordered from mytyres, tyre arrived and few days later so did another, rang them up to inform them and they said they'd deal with. Wasn't till a month later that they rang me up out of the blue to inform me that I had had a second tyre delivered, I said I know I rang up to inform you, they picked it up a few days later at their cost.

I thought you didn't have to send back unsolicited goods?

Thats the part of the distance selling regulations and is to prevent companies sending you things you didn't order then demanding money for them.

abbott did order from the company and due to a mistake the company sent 2 tvs so that doesn't classify it as an unsolictied gift so the company can claim it back (at their cost).
