Every single one of them is scrated to bits and has sweaty greasy finger prints all over them, the games may or may not work i dont i havnt tried them...ill try and get a pic later its just hard to get a pic of a reflective surface like a cd

Ive bought games from ebay before and there was not a blemish to be seen? am i being unreasonable or is this how a lot of people describe things?

If they work then ok i guess but i was basing my bids on the presumption that they were in very good condition which i would assume to mean the odd scratch, he hasnt even bothered to clean fingerprints off these ones.

What do you guys/gals think as this is my first ebay problem of sort

Personally i bought a pre-pwned gamecube game from Game. It was sealed by them but I still managed to get a refund from them even though I opened it, as the disk was a total state and no way was it going anywhere near my Wii.

If you paid by paypal then open a dispute with each item rather than just sending him an email and just explain that the disks are not in the condition described. I dont think he mentions in his auctions if shipping is non-refundable, so I would ask for the whole amount back especially since his items were not as described. You will probably end up out of pocket for the cost of sending them back to him, up to you if you fight him for that money too :p

If you would keep them, then ask for a bit of a refund on them. Point out that saves both of you money really as you both might end up out of pocket with postage costs.

Up to you what you want.
