View Full Version : Ebay help - update (he was screwing me over but has now paid)
I sold something on ebay and posted it via the standard parcels service on the 13th December. The buyer says he has not received it and is making a claim against me via paypal.
What can i do? I can't resolve the situation through paypal because it only gives me the option of doing so via giving a refund or entering a parcel tracking number. And if i don't do anything by the 29th it will go his way and i'll end up out of pocket. Help!

his item will probably turn up later so either he will cancel the claim if he is honest or if he doesn't you have to claim with the royal mail after the refund is issued on the 29th
the receipt is also a proof of posting (better in fact as it shows more details) and a mail claim can be made with it - be sure to write the house number and postcode on the receipt if you have not done so already
Items paid with paypal should always be sent recorded unless you have a reasonable level of trust in the receiver
By using standard parcels you're not complying with the Paypal guarantee (not being trackable) and so Paypal is liable to wip the funds straight out of your account. As I know to my cost! The parcel will turn up I'm sure so try to get the buyer to hang on. One of mine send on the 8th only turned up on the 20th. Parcelforce are rather busy at the moment:

He's still saying it hasn't arrived and is saying he wants a refund as he wants to buy another psp for his son for christmas. Thing is i've checked his feedback and he's bought 6 psps in 2 weeks!
Have now replied and said i cannot issue a refund unless i know for certain it is lost, and royal mail told me that is after 15 working days. Also said i've checked and seen he's bought these other psps.

Looks like he's trying it on but what I can't believe is that you sent a high value item using normal post, does the insurance on the item cover the value of the item?

OK, you can pay extra to cover the value (which I hope you did otherwise you'll only get £30 back!) but for only a couple of quid more I'd have saved my own arse and sent it Special Delivery..
Bit late now, mind..
I'd try and contact the other sellers hes bought PSP's off of to see if they are also getting grief off him for them not arriving, seems very sus. However you have shot yourself in the foot in paypals eyes with no delivery tracking.
I only accept Payapl if the buyer pays for Special Delivery as I've been shafted one too many times by buyers saying goods haven't arrived and Paypal siding with them because of the lack of tracking evidence (even if the buyer insisted on the cheapest despatch method).

You took a chance and broke the paypal rules .... looks like tough luck.
For items less than £30 I get a "certificate of posting" it's free, all you have to do is ask at the PO counter. If they say it doesn't arrive and paypal do a chargeback you can ask the PO for the money. Anything over £30 and you have to use Special Delivery or risk a loss.
Just an update on this:
Paypal refunded him in the end as i couldn't provide a tracking number and he claimed the parcel wasn't received. My account has now been suspended until i add the remaining £6 to my account that is the last of the refund to him (something of which i have no intention of doing).
Anyway i've been checking his feedback and items sold/bought, and he's definitley in the business of buying psp's and selling them again. And in the past couple of weeks he's had several negative feedbacks.
One in particular has a reply from him saying "my brother stole package so i think it hasent been sent and im a conman". So i emailed the seller who said that he had made a paypal dispute against her for non-delivery, but she noticed that he had actually sold 3 games that he bought off her, so obviously had received the package!

its covered under The Theft Acts of 1968 & 1978. Its obtaining goods through deception. Complain to the police with any 'evidence' you may have. Get a crime number.

agree - pass it onto the police, but be careful if you do neg him on how you word it - if it goes to court, and he's found not guilty, you don't want to appear in court on a libel charge !

(Although he might have the foresight to send it out via a secure carrier)

He sounds really dodgy so I would definitely report it to the police and ebay (although they will most likely do nothing). I wouldn't give any feedback at all in this situation.

- he raised a paypal claim only 4 working days after i sent the item, when i had already told him several times it takes longer, especially at xmas
- because of the other negative feedback he's received and communicating with someone else who sold him a psp and he lied about it being delivered
- because he hasn't chased me for the rest of the refund and if it genuinely didn't arrive then surely he would've
- because i've lost a psp and games
Based on everyones suggestions though i may not give feedback and just complain to ebay and phone the police. Will the police actually do anything though? I can prove i posted it, and there's probably a few people who've dealt with him who would agree that's he's dodgy, but isn't it a bit 'small-fry' for the police? What if i sent him a message saying i've done some investigation and will be contacting the police as i believe he received the psp??
Edit: Just to add to my suspicions the 2 games that i sold with the psp are 2 games that he sold individually on ebay after i sent them.

I think reporting it to eBay (http://www.thedvdforums.com/jump2.php?url=http://www.tkqlhce.com/click-582776-5826355)and the police is all you can really do, whether anything will come of it other than him possibly being suspended from trading is another matter. The police will take your complaint but you are possibly right with it being a bit "small-fry", unfortunately they don't have the resources to check all these, and as we know ebay is a thieves paradise. I would contact as many people as you can from his trading records and get their co-operation, if you can present a long line of fraud, then the police may be more interested.

your first reason is maybe good enough for a neg, but not the others
second one - nothing to do with your transaction
third one - he could just be lazy - not a reason for a neg
fourth one - just because you've lost them doesn't prove he has them
Ahhh its a lesson from the school of hard knocks for you.
You NEVER send anything worth more than £30 unless you insure it , either special delivery or other insurances on standard parcels or parcelforce!
Leave the neg... claim back your £30 you are allowed to from royal Mail... and move on
Otherwise try and get authorities involved .. but with no tracking??? you are screwed.
Standard parcels would've been fine IF you'd insured for full amount as then if he lies.. you claim off royal mail and they refund ... he still gets goods by deception due to no tracking but at least you don't lose your money.

Just an update on this:

i believe he's a fraud and shouldn't be trading on ebay.
A very tough lesson, but why would you send a valuable item without using special delivery? Were you trying to save money? Paypal sides with buyers, so you need to protect yourself.
You have no proof that he is a fraud. Will be very hard to prove. As regards the police, they will probably tell you to be more careful in future, i.e use an insured mailing service.

Well i was right, he was basically trying to screw me over. I sent him an email yesterday saying that royal mail were investigating whether the parcel was delivered or not, and that i had done some investigations and was going to contact the police. I then listed the reasons why i thought the parcel had been delivered and that he was a fraud.
Anyway got an email today from him saying that the parcel was delivered 4 days after the payapl dispute ended, and he tried to contact me but it obviously failed (yeah right), and that he will pay me back, but his paypal account is overdrawn and he's on the dole and it will take a few weeks! Can't believe it!
The question is what do i do now? Do i wait several weeks before he can pay me back, then leave him negative feedback and report to ebay and paypal?

I'd tell the police to be honest. No piont keeping it between you and the conner as others will fall fowl, if they have done it a number of times, whats stopping them continuing even if you do get a refund.
Someone local to me got a sentence or heavy fine (can't remember which) for doing this.

Report him to HMRC as a trader. If he is on the dole he could have dug himself into a deep hole.
Right well i've now said to him that i want all the money in the next 2 weeks or i will take things further, and he's going to send me a postal order by recorded delivery. I think as soon as i get my money back i'll report him to the HMRC.

Right well i've still not had anything from him, so have now contacted ebay and paypal, and have reported him to the police. See what happens next!

It does cost to do this but that gets added on to the money he owes you (although of course there is a chance the lying scum might not care about a CCJ and still ignore you).
Prob not until the police have done their investigations. Just had a phone call from them asking further questions. They gave me a crime number and said an officer would be assigned to it!
Update: the money has appeared in my account. Don't know whether the police would've contacted him already (doubt it) but it's there.

Money has now cleared and have informed the police of this.
Now need to leave feedback but unsure what to say - can anyone help? I know there are certain rules you have to adhere to, and the 80 character restriction is limiting.
Want to say he's a fraud but doubt i can?
