View Full Version : Talkworldonline - Can't get my cashback?

I've bought two phones from this company last year on their 12 month free line rental after cashback offers. Deal is basically you get your cashback after sending in your sixth monthly bill and they agree to give you your cashback within 28 days.

With my first phone they were very slow and I had to hassle them with emails before they finally issued me my cheque about a month late. With my second phone I sent in my cashback claim in November using Special Delivery (which means it got there!).

Having received nothing I've tried to contact them by several emails (to which they haven't responded) and no one picks up their phone. Usually they have been pretty good at replying to emails within a day and as recently as last month, when both phones developed faults, they quickly agreed to get them repaired under warranty. I sent the phones back and they repaired them and sent them back at the beginning of this month.

However, since I've been emailing them about my second cashback claim they've gone all silent on me. I am planning to pay them a visit as their head office is a 30 minute train journey away from me. Any advice on what I should do?

Rung Trading Standards or issue a CCJ via money claim online (after giving notice) if you're in the right they'll squeal though may call your bluff right up till the last minute

Likewise it has been the same for me until this latest cashback claim. I've been emailing their support as well as Danielle who has previously responded to my emails. None of them have bounced so they are getting through. My last correspondence with them was on January 20 when I got my phone repaired from them. They've stopped responding the moment I raised the issue of my cashback in several emails this month.

How do CCJ's work? Also who do I contact in trading standards? I'm planning a visit to head office sometime this week to see if I can get anything sorted out as well as handing a notice setting them a some sort of deadline to sort this out before I take further action.

I also am having issues with talkworld online. I started a thread couple of weeks ago in the suppliers forums, but had no reply...so i just assumed mine was an isolated case.

I have also tried ringing them constantly and emailing them for the last three weeks and nothing.

As I said earlier, they were always good at responding to emails but recently they've gone dead. I'm planning a visit to their head office tomorrow demanding to receive my cashback as well as giving them a notice that carries the threat of a CCJ.

Same problem here too, sent a claim 30th November, chased them up about it on 30th January got through to someone quickly and they said the cheque would be in the post that week. Still haven't received anything and tried calling today and impossible to get an answer.

I have had a phone from them in the past and the cashback came through fine, albeit after I prompted them and they have answered their phone quickly which worries me that perhaps they are going out of business? They have a store in Essex by the looks of it, has anyone been there lately?

Have any of you had any luck with the email address huggons gave? If you don't mind passing it on I would like to give that a shot too: m4tthew_ukAThotmailDOTcom

Sorry for not responding earlier.

First port of call Trading Standards. It needs to be in the Trading Standards office where the BLEEPS are based (for example when I contacted Just 3G, I needed to contact Birmingham Trading Standards as that was where Just 3G are based). Trading Standards website should have all the relevant numbers.

Trading Standards will set up a meeting with said company but to be honest, in my experience, this was pretty useless. However, it's advisable to contact TS as this might come into play later (to show you went through "the process" before getting rough -- hehe).

Next port of call is to confirm that you will be launching a CCJ if you do not receive your cashback.

Give a suitable response time (3 working days -- 5 if you contact them by post).

Then, if no response, let the fun begin! Most companies will call your bluff as most customers "let it go" -- DON'T!

Go here to register and fill out your CCJ (will initally cost £30 but this can be recouped later by the companby that owes you money) - very, very, very easy, all self-explantory, all details listed on the website. The Courts Service will then send out a Notice to the BLEEPS who have 14 days to respond. If they don't respond within 14 days, a CCJ is issued. After which it may go to local court - but if you're in the right, then you'll get your money back and the company responsible will cover all your costs.

Yes. I will keep the thread uptodate with my progress. I think I might add the cost of the £5 train ticket into any future claim I make :lol: .

Seriously mate, I would consider doing it the long distance way. The only way Just 3G paid me was when the Courts made them pay me. If they discuss it with you they might pay up, fair enough, but they may fob you off in which case you're back to square one (cheque's in the post, 30 days to clear BACS payment, etc. etc.)

With the CCJ you can also claim interest on any money owed (IIRC).

I see your point but considering the cashback was due within 28 days they are overdue and breaking their contract. I can simply say to them that they've got one week to give me my cheque before the courts get involved. Only reason I'm considering a visit to head office is A) it's reasonably close to me and B) I'd rather get this sorted quickly instead of getting the courts involved (though I'm prepared for it if it's necessary!).

Actually I've decided to go with DrX's advice and go straight for a CCJ instead of visiting them as it would probably end up delaying the inevitable (and I can't be bothered to waste half a day!). I have already informed them by post and email that I will be taking them to the courts if they haven't paid me by the 6th of March.

Same issues, sent cashback forms in Oct 05, no cheque. Some story was given to me re changing banks, i warned them of court action, Communication seemed to stop in Feb. Got fed up and now going through the online small claims procedure. (Issued 16 feb) no reposnse yet.

Some info i have found out, they are a small shop on the high street. Someone visited them. The shop was closed. They're not big!!!!

I have found the following from Companies House
Parent company seems to be Comtec (Essex) Ltd
Incorporated 1993 and still running
2 other companies registered at the same address are :-
Talkworld Online Ltd, incorprated 2003 and still active as far as companies house is concerned.)
Talkworld Website Ltd, incorporated 2004, DISSOLVED 31/01/06!!!

Mate I am about to go through the small claims procedure. Who did you take the action against? I see their website is still online and accepting orders under the name Talkworld Online Ltd. This isn't the same as Talkworld Website Ltd is it?

I did send a written warning to the Talkworld Online Ltd. Head Office in Brentwood saying that I would issue a county court judgement if I didn’t receive my claim by March 6. Should I go ahead and claim against them or should I be claiming against the parent company Comtec (Essex) Ltd?

Could you also please give me a link to the other forum you mentioned that had a thread about Talkworld?

I have been trying to ascertain their company status as not answering the phone, replying to correspondence etc doesnt paint a good picture, so I dig some digging and uncovered their accountants, who told me yesterday that they believed the company to have ceased trading.

IF this is the case I would advise against lodging a small claim at this stage as it does not give you any advantage over any other creditors in a liquidation (as far as I can tell) so I would hang fire for a bit longer to find out for definite.

Sorry to be the bearer of what appears to be bad news.

I was reading the Insolvency Service website (http://www.insolvency.gov.uk/) and I'm not sure what to make of it.

The bad news is that if they have gone bust and are being liquidated there is only a very small chance of getting money. What I am doing is hanging fire and finding out exactly what is going on before claiming. If it looks like they are being sold, or continueing trading I will initiate small claim processes. If not I will lodge a claim with the official receiver (or whatever the title is).

It's not looking good for getting anything I dont think.

The only hope I seem to have at this moment is that the Companies House register hasn't got them listed as dissolved (yet!) and their website still seems to be active and taking orders (though it's questionable whether they're being fulfilled).

Well I've seen the thread at ******* and MoneySavingExpert. There are many of us in the same boat. Maybe it's time we merged together for a collective complaint to Trading Standards, legal action and possibly the BBC's Watchdog!

I contacted Orange by email and explained the situation to them (no threats to them or requests for the money). I got the following reply:

Unfortunately we are unable to assist you in this matter. However, we are able
to send a dealer incident form so that this can be investigated.

Hello, in December I responded to an offer made by a company called Forward Cellular who were offering what seemed like a good deal - pay £10 for a SIM card, and receive a deal which was effectively free of line rental, as Forward Cellular promised to reimburse the cost of the 12 months line rental by way of a cashback cheque.

I'm not in the business of dealing with companies who make claims that seem too good to be true but in this case I was aware of others who have successfully received cashback cheques from this company so thought I was on solid ground.

After my first monthly bill was received, I posted it off to Forward Cellular as per the terms of the cashback offer, but a week later I received a letter from the liquidators of the company advising me that the company had gone into liquidation and that I would not be receiving my cashback.

This leaves me in the position of having received nothing but a SIM card, yet obliged to pay 12 months worth of line rental to Vodafone totalling £285, which I feel is a really unfair situation for me to be placed in both ethically and morally, as I was prepared to fulfil my part of the bargain, but the company that offered the deal was unable to fulfil their side of it.

Indeed it seems likely that the company must have been aware of its impending financial problems in December when I took out the contract, yet they were perfectly happy to sell me the offer probably in full knowledge that they were never going to be able to provide the cashback they had promised.

I'd argue that this shows that Forward Cellular have acted fraudulently and I am left holding the result of their bad business practices in the form of a £285 bill that I never intended to pay.

I'm hoping that Vodafone will be able to assist me in either offering me the line rental for 12 months at no cost, or by cancelling my contract immediately with no penalty to myself."

The guy's answer was: "Okay, no problem, I do understand, and I'll cancel your contract for you now and there should be no further charges on this account. Thanks!

Just received a letter from the liquidator this morning about a meeting of all talkworld online creditors on 19th April in west London. anyone else got this?? It also mentions cost of £10k for something or other which i dont quite understand. i would be grateful if someone can enlighten me.
