Basically my Crystal XBOX, yes the real Limited edition , is dying. The hard drive is making awful noises and keeps crashing Halo 2 which is really annoying me. Basically it's been a bit dodgy since about 2 months old but as I didn't want it replaced with a non limited edition I haven't bothered taking it back. Now it's gone too far and I've had enough.

So the question is: Who is responsible for replacing/repairing it. As it's only about 8 months old I know someone should. Can I take it back to where I bought it and demand a new one or do I need to contact Microsoft. I would really prefer to take it back to the shop and swap it but I'm not sure weather the store are still liable for it.

I had exact same problem last week. My x-box died with only 13 days left of warranty. Took it back to Currys and the guy checked it out and said the hard drive was the most likely suspect. He went off and came back with a brand new crystal one :) and a years waranty also. IMOH if you have the receipt from GAME then they should replace/repair.

Thanks for the reply. I'd like to know legally where I stand before I go into the store and demand a new one. I know they should swap it but do they have to? Also what do I get if they do swap it? Will I effectively get credit to the same ammount or will I get a new crystal XBOX which won't be the same as mine?

Just phone up GAME and ask - TBH, I'd expect them to say phone MS instead as its a fairly long period since it broke down. MS are very good on any sort of hardware swapouts so I wouldn't worry at all. But if you get lucky, GAME may just swap for you there and then if they have stock in!

When I bought my Xbox from Game they told me they would replace it for upto a year if it went wrong. :)

The retailer is responsiblre as they sold it to you NOT MS

Now they may well just send it back to MS so you could just cut out the middle man

But GAME are responsible until the day the warranty expires.. after that you can try your luck using Sale of goods act and contact MS as the 1 year warranty is of course in addition to your statutory rights.
