View Full Version : paypal / ebay problem..pls help?
hi guys
i recently sold a pair of jeans to some guy in the states for just under £30
he never took out insurance on postage and has not received them as yet..he has made a complaint to paypal and they are giving me 3 choices..
Status Details:
We are currently waiting for you to choose a resolution method for this complaint.
As stated in the PayPal User Agreement, you are required to resolve any complaints within seven days of the filing date (by 19 Aug. 2004), using one of the following methods:
Provide a refund to the buyer for the full amount of the disputed transaction
Provide tracking information confirming that the item was posted
Provide proof that you already issued a refund to the buyer for the full amount of the disputed transaction
If you do not attempt to resolve this case in the specified time period, we will process the buyer's refund, and access to your PayPal account may be limited.
as there is no tracking number as it was regular post and i do not want to offer a fefund as i have stuck to my word on the sell...what can i do!
i have used paypal with ebay for dvds and things for 59 previous sucessfull transactions!
any advice appreciated!

If you have no proof of postage, you're boned. They will take the money from you. You didn't get a Certificate of posting ? You'll know next time then, unfortunately...
When did you send the Jeans? I recently had a similar probalme but the CD turned up 3 weeks after delivery.
i did obtain a certificate of postage..do u mean a small white postcard which u fill senders address on front of..which the post office initials / signs and dates with a stamp?

Did they go by standard surface mail? I've had packages take nearly 3 months to get from the US via surface mail!
i was told regular first class airmail would take 10 working days!

I would say that you have complied with option 2 if you got the certificate stamped and dated. You have proof that you sent the item. What did you put on the 'postal insurance tick box' in your auction?

That is an estimate. The item I mentioned earlier took 22 days to arrive

Airsure is not covered by this, but International Signed-for is.
You will have to refund unfortunately, or Paypal will do it for you.

e-mail them a copy of the proof of posting. I don't think tracking is possible to the USA unless you use FEDEX or UPS.
Sounds like a scam to me.......why the hell would a yank want to buy a pair of jeans from the UK? what jeans were they? Versace? Armani?
open up another paypal account, and transfer the money out if its not too late.......i think they freeze it.
Besides, it seems like there has been a few issues with the royal mail lately.

If the seller offered insurance and the buyer opted for a cheaper shipping option, and the seller has proof of postage, it's the buyer's problem.
I'd provide Paypal with the proof of purchase. If you feel Paypal is operating unlawfully you can get your credit card to chargeback the debit (if your Paypal is set up from a credit card). My credit card won't even permit Paypal transactions as they regard them as dubious.
I've had extended wrangles with both eBay and Paypal over issues relating to fraud. Their customer service levels are abysmal.

for postal insurace i offered optional which he decided not to take at a cost of an extra £2:50!

It's a shame that the guy got Paypal involved.
If you still can, refund the guy for his jeans, then put in a claim with Royal Mail for the missing jeans as you have a proof of postage certificate, so you can claim up to £28 from Royal Mail.
If Paypal simply take the money back from you, then you will lose the money and they will charge you a fee. It's happened to me twice, and I think it was around £7.

Well, if insurance was offered, then send proof of posting and that should be more than enough to settle this. Paypal are not looking for extra work, once they are satisfied you were legit they will just close the case.

If they cant track it online, I doubt that they'll be interested. I would imagine that they'd want to know whether the item has been received as much as whether it's been posted.

I can't believe that PayPal won't accept the signed proof of postage from the post office, aliong with the offer of postal insurance on the original auction, as evidence of good intent.
If they came down that far biased toward the buyer on every occasion then we would all be at it!
Most of the stuff I've had off eBay has just gone through normal post or recorded delivery.
What PayPal are saying is "Complain to us and get your stuff for free!"

PayPal do restrict you to two claims per year - but its still annoying.
I only post to Confirmed addresses, and always use a trackable method for posting, costs a bit more, but it's definately worth it if you get a pain-in-the-edit buyer.

Apply to UK also. You need to use Recorded/Special Delivery or International Signed-for.

As Dan said, this also applies to transactions between the UK and US. But it must be sent using one of the following services.
What methods of online tracking are acceptable?
The following options may be used:
Parcelforce Worldwide
Royal Mail - Special Delivery
Royal Mail - Signed For
Royal Mail - International Signed For
Royal Mail - Airsure
UPS
FedEx
Airborne Express
DHL

but can you do signed to the USA? When i tried this once, it wasn't possible. Theres several countries that you cannot insure or get signed on delivery, i believe USA is one, Brazil another.

You can now with International Signed For. I think this was only introduced fairly recently

besides, if insurance was an option, and it was declined, then surely the buyer doesn't have a leg to stand on if the seller has proof of posting?
Personally, if paypal took the money back from me, i would file a small claims court action against paypal......just for kicks :) i'm sure the court would rule with the seller.

International Signed for is available to the US with compensation up to £30 or up to £500 for an extra £1. There's a booklet at the PO with all the details called "Reach The World".

This is what I would do anyway, to be honest, regardless of an issue with PayPal or not. I always include insurance in my P&P charges - it's never optional.
