View Full Version : Can they refuse a refund???
I went to return my iPod back to MicroDirect earlier today as it was incompatible. I only bought it last friday and they refused to refund me or even give me a credit note. It was in top notch condition and had all the peripherals still in the packets etc... I was even polite to the guy for a change...
Their excuse was the price of the item is too high to resell.. The fella behind the counter claimed that legally they can refuse a refund if they wanted.. When I asked them to prove this, he showed me some few sheets that were according to him were taken from "10 Downing Streets Website" :cuckoo: I asked to speak to the manager, but obviously the cronie didnt let me and said that he would speak to him himself... So off he went and came back 10 minutes later saying that they will only accept return of the goods if I was willign to let them charge a restocking fee.... The restocking fee would be "at least 25%" I told them to shove it soo far up their EDIT and stormed out of the door...
What would you guys suggest... Can they legally do this or are they just fobbing me off now that the 4g ipod has been released!! Ive always been loyal to the muppets and I cant believe these cowboy methods of running a business... :mad:

Stick the 7 days long distance selling law in their face.
You can refund an item using that law with any reason within 7 days.
but i bought over the counter from them!!
if you bought in a shop over a counter legally they don't have to give a refund :(

Maybe had you been polite to him all the time he might of exercised his discretion and made a goodwill gesture of a refund seeing as the Distance Selling Regs do not apply.

Did you ask in the store if it was compatible?
The sale of goods act says that goods have to be fit for the purpose they were sold for.
If you said at the time of purchase that some compatibility was required then the law says they have to refund the money.
Of course, if it comes to a court case it is only your word against theirs...

splobber - What i meant was Im pretty narky when it comes to stuff like this, and ive never asked for a refund in microdirect before.. so in all honesty to him i was just some toss pot of the street... i was really nice to the fella too, with the exception of walking out of the door..
BTW the print out of the sheet of paper from "10 Downing Street" had written on it that legally i can return it if its not "fit for the purpose its intended for." Too right it isnt fit for the purpose.. It doesnt work... but he said its made to play mp3s, and it does that... :(
AdminSpod, i actually asked the guy if there would be any compatibility issues... He said there shouldnt be any problems and pointed to the returns counter if there were any! I told the returns desk fella this too, and he went and asked the person who served me, and he denies this!!
Similarly, I dont have a firewire port, and the same guy who told me about the returns counter said that it had a USB cable in it... But when I opened it, it didnt, however I wasnt too bothered about this and went and bought a USB2 one too!!

Yep, they are within their rights to refuse a refund unless its broken, faulty etc. I bought a telly and dvd player from Tottenham Crt Rd last year and on getting home I found it far cheaper on the Net. They refused to refund me even though it had only been three hours since I bought it and it hadn't been delivered yet. The trusty Barclaycard price promise came to the rescue though! :-)
i bought it on my AMEX card... Would this cover me!!

you sure it aren't your pc that is borked? or the ipod itself is broken. Doubt it's incompatible, it's probably one of the other is broken.
it probably is my PC in all honesty, but at the moment I really dont want to mess with it and reinstall windows... When I do get round to doing it, we probably see the 5g iPods...

Errr why can't they do this? You have got a product home and opened it. You now expect them to take it back and give you a full refund? What are they supposed to do with it?
a) Sell it as new - Would you be happy receiving a product in such a state? Didn't think so.
b) Return it to apple - They are very unlikely to refund the retailer for the stock unless it is faulty.
So all in all, they would be left with a completely useless item of stock because you made an impulse purchase and expect them to bail you out? Sorry if this sounds a tad harsh, but the way you just expect them to have a legal responsibility to take the fall for you when you have made an incorrect purchase which is entirely your fault seems a little out of order to me.

Damn right it's fair. If you could just return anything you'd bought because you felt like it, why would any company ever sell anything? It's not worth the risk of being left with useless stock.
I can't believe you honestly think you deserve to get your money back?! Not only that but you're prepared to lie about the product in order to convince the store.
I certainly wont be selling to you on the classifieds.
