My sister bought me a dvd, The 6th Day / Last Action Hero (Schwarzenegger Action Pack), recently from play.com for my birthday. I believe she bought it one to two weeks ago and my birthday was yesterday.
When she gave it to me I could hear something rattling inside it but when I took off the clear wrapping protecting the case I realised that the case was chipped and both the top and bottom. The contents of the dvd case were fine though.
I emailed play.com but I thought I would ask here in the meantime to see what I should be expecting them to say. It should be returned in my opinion as it is technically a faulty product and no one wants a faulty product.
Has anyone else ever had this sort of problem and if so what did they do about it? Does consumer law protect me in this case cause I was not able to find anything specificic enough.

edit: After reading their T&C I fear I might be beyond the 10 day period:
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Play.com shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify Play.com of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the goods. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
However I hope they make an exception due to the fact it was not given to me until yesterday.
