very cheap for winxp pro, even if it is OEM... and free int'l shipping.. $40... should i avoid it like the plague or snap it up as a bargain? cheers for any advice!

No, you can't, that is almost definately dodgy software, as Adobe don't sell OEM photoshop, certainly not at that price!
